Asking Employees to do More Could be a Violation of FLSA

In times of government shutdowns, furloughed employees and companies trying to do more with less, you may be asking a lot of your employees. But, what if you are asking too much and violating the Fair Labor Standards Act (FLSA)?

In a recent case, Heyen v. Safeway Inc, Linda Heyen sued Safeway after they terminated her employment as an assistant manager. She brought the suit to recover unpaid overtime pay, contending Safeway should have classified her as a "nonexempt" employee because she regularly spent more than 50 percent of her work doing "non-exempt" tasks such as bagging groceries and stocking shelves. The court agreed and awarded her overtime pay of $26,184.60 plus interest.

Safeway appealed, arguing that the court failed to properly account for hours, she simultaneously performed exempt and nonexempt tasks, i.e. actively managing the store while also concurrently performing some stocking and bagging of customer grocery purchases.

Depression in the Workplace: Is it a Disability?

In light of the recent shootings at the Washington Navy Yard, mental health is once again the topic of conversation in the media. And, it should be. The statistics are staggering. According to the National Institutes of Mental Health (NIMH), 6.7% of the U.S adult population suffers from depression. That translates into almost 20 million people. Of those cases, 30.4% of these cases are severe. Depression is the number one cause of disability in the world.

With those numbers, there is no question that as an HR Manager, you will have to understand the legalities around dealing with depression in the workplace.

COBRA Non-Compliance, More Expensive Than You Think!

In 1985, Congress passed the Consolidated Omnibus Budget Reconciliation Act (COBRA) and President Regan signed it into law in 1986. COBRA gives workers and their families who lose their health benefits the right the right to choose to continue group health benefits provided by their group health plan for limited periods of time under certain circumstances such as voluntary or involuntary job loss, reduction in the hours worked, transition between jobs, death, divorce, and other life events.

It's Time for HR to Get Ready for EEO-1 Reporting

Last week, the Equal Employment Opportunity Commission (EEOC) announced that it had completed its mailing of the 2013 EEO-1 Survey Notification Letters. The EEOC collects workforce data from employers with more than 100 employees (lower thresholds apply to federal contractors).  Employers meeting the reporting thresholds have a legal obligation to provide the data; it is not voluntary.  The EEO-1 report requires employers to provide a count of their employees by job category and then by ethnicity, race and gender.

Because the Fair Labor Standards Act (FLSA) has specific requirements regarding overtime pay. If you mis-classify an employee, your organization is subject to severe fines. And, while no one wants to pay fines, let's remember that the intent of the law is to protect the worker from abuse by the employer.
